This circular provides administrative guidance on the application of the law relating to planning and nature conservation as it applies in England. It complements the expression of national planning policy in Planning Policy Statement 9: Biodiversity and Geological Conservation (PPS9) and the accompanying Planning for Biodiversity and Geological Conservation: A Guide to Good Practice.
Although this circular outlines how statutory obligations impact within the planning system, in some cases the legislation will have an equal bearing on other regimes eg Transport and Works Act 1992.
This circular should be read in conjunction with PPS9, which sets out the Government's planning policies for England on protection of biodiversity and geological conservation through the planning system and the accompanying good practice guide.
